9. Foreign Usage
This Website is controlled and offered by BCC from its facilities in the U.S.A.  BCC makes no representations that the BCC Website is appropriate or available for use in other locations.  If you access or use the BCC Website from other jurisdictions, you are responsible for compliance with local law.

10.  Donations and Ticketed Events
10.1  BCC does not process your donations or collect your personal financial data on the BCC Website.   Your donations are processed through PayPal and you may use an existing PayPal account, credit card or bank account to make your payment (subject to availability of each method).  Refer to the Privacy and Security policies on the PayPal donation web page for information about how PayPal collects, handles and protects the security of your personal financial information.  Neither BCC, Buchanan Street Partners, their affiliates or agents, or any other parties involved in the preparation or publication of the BCC Website are responsible for the security of the personal financial information you provide to PayPal.

10.2  The BCC Website may offer opportunities to request tickets to certain concerts and other charitable events in conjunction with your donation.  All such tickets may not be resold.  Further, BCC cannot guarantee the availability of tickets at the time of your donation.   If an event sells out or tickets are otherwise unavailable, you may request a refund of all or a portion of your donation.  BCC will make reasonable efforts to notify you of the unavailability of tickets in such circumstances. 

10.3  BCC, Buchanan Street Partners, their affiliates or agents, or any other parties involved in the preparation or publication of this site are not responsible for any failure of ordered tickets to be delivered to you on time and cannot guarantee seat locations or special accommodations.

11.  General
These Terms of Use may be assigned by BCC without restriction.  If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.  No waiver of any term of these Terms of Use shall be deemed a further waiver of such term or any other term, and BCC's failure to assert any right under these Terms of Use shall not constitute a waiver of such right.  These Terms of Use, together with the BCC privacy policy, constitute the entire agreement between you and BCC concerning the BCC Website.  These Terms of Use shall be governed by the laws of the State of California, without regard to its conflict of laws principles.  Any claim or dispute between you and BCC that arises in whole or in part from these Terms of Use or the BCC Website shall be decided exclusively by a court of competent jurisdiction located in Orange County, California.

("BCC") is committed to protecting your privacy when you visit our web site(s).  Information we collect from you is used to improve our site, provide you a better experience, respond to your questions or requests, inform you of changes to the site and process your online donations.

BCC collects information on our web site. We do not provide, sell, trade or rent our web site visitors' personal information to others other than third-party service providers providing services to BCC under written obligations of confidentiality.  If you willingly provide us your personal information, BCC may use it in the following ways:

Donor Lists.  When you make an online donation to us, we will add your personal information to our donor records.  We may place your name on a list of donors and display all or part of this list on our web site or in our other publicity materials.  As a donor, you may request to have your name removed from these lists.  See the Correcting Information or Opting Out of the Use of Information section below to learn how.

E-mail Mailing Lists.  When you contact us via e-mail or the contact form on the web site, send us information requests or questions by e-mail, or make an online donation to us, we may collect your e-mail address in order to respond to your message and to send you notices of site updates, event information, e-mail bulletins or news.  To opt out and remove your name from the list so that you do not receive future e-mails, follow the unsubscribe instructions in any message you receive.

Event Registration.  The web site may provide opportunities to perform online registration for our major events.  We may collect your personal information, including your e-mail address and send you notices of site updates, event information, e-mail bulletins or news.  To opt out and remove your name from the list so that you do not receive future e-mails, follow the unsubscribe instructions in any message you receive.
